This Web site is owned and operated by SecuraTrac LLC ("SecuraTrac," "we," "us," or “our”).  Please read these Terms and Conditions (“Terms”) carefully before using this website and know that your use of this website represents your acceptance of these Terms.  We reserve the right to change, add, or remove any of these Terms at any time by posting changes on this page.  Your use of this website following the posting of changes to these Terms means you accept such changes.

Those users who subscribe to the monthly SecuraTrac service are required to provide accurate and complete information about themselves and to maintain the accuracy of that information.  During registration customers create a username and password and both pieces of information are known as the customer credentials.  Customers are responsible for maintaining the confidentiality of these credentials and are responsible for all activities that occur under those credentials whether expressly authorized or not.

User Conduct

As a user of this site you expressly agree that you will not use this website for any purpose that is unlawful or prohibited by these Terms.  You agree to abide by all applicable local, state, national, and international laws and are responsible for all acts or omissions that occur under your credentials including, but not limited to, the content of any communications that are made using services provided through this website. 

Any unauthorized commercial use of this website, SecuraTrac’s servers, or Internet infrastructure is expressly prohibited.  Without SecuraTrac’s prior written consent, you may not reproduce, distribute, modify, display works based on, repost, and/or otherwise use the content of this website.  We reserve the right to monitor, review, retain, and disclose any information collected from or about you related to your use of the website that is necessary to satisfy any applicable legal or governmental request. 

SecuraTrac reserves the right to terminate your account at any time for any reason. Any and all registrants under the age of 18 years old should get the authorization of their parents and/or guardian before using the website.

SecuraTrac 30 Day Guarantee

SecuraTrac has spent a great deal of time developing a high quality product and service.  If you are not completely satisfied with your SecuraTrac device and service, you may return the device within 30 days from the date of purchase for a full refund less the shipping and handling fees, subject to the terms and conditions that follow.

When you decide to return the product and cancel your monthly service you should first call SecuraTrac Customer Care at 888-9SECURA in order to request your Return Materials Authorization (RMA) number and cancel your monthly service. You will need to include the RMA number in order to receive a return label needed for the box. Note: return shipping is not prepaid and must be paid by the customer. The device and accompanying accessories and documents must be returned in good-as-new condition in the original packaging. The package must be postmarked on or before the 30th day from the date of purchase and the RMA will only be valid for up to 10 days from the date of issue. In order to ensure a prompt refund, include the RMA number and the proof of purchase – a copy of your credit card statement or a receipt. If these conditions are met, we will refund your full price of your purchase including sales tax less the shipping and handling within 15 days of verifying the receipt of the returned items in the proper condition.

In addition to refunding the device and accessory costs, if the service is cancelled prior to the end of the 30th day of service second month of billing we will refund the first month of prepaid service or the entire prepaid service for customers who prepaid for 3, 6 or 12 months of service. If the service is not canceled cancelled before the end of the 30th day of service there will be no service refund or credit. This 30 day guarantee applies equally to customers who have agreed to a 12 month service commitment. 

In order to ensure that your service is cancelled in a timely manner you should contact SecuraTrac Customer Care at 888-9SECURA.  If you have not cancelled your monthly service by the time we receive your device, we will cancel it for you and will provide the credit in accordance with the terms described in this paragraph.

If you fail to return all items originally shipped with your order, SecuraTrac will charge a $25 re-stocking fee in addition to the retail price of any missing items.

SecuraTrac does not believe in and, therefore, does not charge activation fees. If, annual term commitments, or early termination penalties. Anytime after the 30 day quality guarantee expires you are on a month-to-month service plan and the 30 day quality guarantee has expired, you may able to cancel the service or suspend the monthly service at anytime for any reason and all billing will cease at the end of the current prepaid period. This includes any device insurance that may be part of your agreement. Note: a stoppage in device insurance also nullifies your ability to take advantage of the replacement service offered by the device insurance program.

Cancellation of a Service Term Commitment

Customers who have purchased a SecuraPAL device at a deep discount in return for a long term commitment (1, 2 or 3 years) can take advantage of the 30 day quality guarantee. After the 30th day of service, however, the full term of the service agreement must be honored. In the event that the customer would like to cancel or suspend the monthly service, SecuraTrac will apply an early cancellation fee to the final customer invoice and will automatically charge the fee to the form of billing provided by the customer. The early cancellation fee will be equal to the full amount due to the company based on the remaining months of the terms of service.

Wireless Service Fee Billing

The service fee for wireless communications will be automatically charged to the form of billing provided on the monthly anniversary date or the appropriate anniversary date based on your service plan. If your billing date falls on an irregular day of the month, you will be billed on the next closest date.  For example, if your anniversary date falls on the 31st of a month with less than 31 days, you will be charged the next monthly service on the 1st day of the following month.  The following payment will be billed on the original anniversary date or, again, the following business day of the next month.

In the event of a declined billing attempt for credit and debit cards we will try to process the payment 2 more times within a 7 day period following the billing anniversary.  If, after 7 days we are unsuccessful in processing payment, we will cancel the account.  Re-starting your service will be subject to a re-start fee for the month-to-month plan or a multi-month service option (3, 6, or 12 months of prepaid service).

Service Coverage

SecuraPAL devices use radio transmissions, so we cannot provide service when your device isn't in range of a transmission site used to provide service.   In addition, when inside SecuraTrac network coverage areas there are many factors, including network capacity, terrain, proximity to buildings, foliage and weather, that may impact availability and the quality of the service.

SecuraTrac provides global wireless service. Your wireless pricing is based on your country of record and entitles you to unlimited location requests for a single fee for that country. The SecuraTrac network also allows you to take your SecuraPAL with you when you or your family travels to other countries. We provide coverage in many countries in North America, South America, and Europe. You are responsible for all wireless service charges. In order to get the best rates for countries other than your country of record, please call Customer Care prior to using your SecuraPAL internationally.

Service Re-start Fee

After canceling your monthly service, if you choose to keep your device you may do so.  If you do decide to re-start your monthly service, all you need to do is call us at 888-9SECURA or send us an email at [email protected] and clearly state that you want to re-start your service and provide a contact phone number.  We will call you to confirm the details and re-start your service. 

There will be a one-time, re-start fee of $50 in addition to the then current monthly service fee to re-start the service.  As long as the device and SIM card are still compatible with our service and that of our strategic partners, you will not be charged anything further.

Refunds or Returns After 30 Days of Service

After canceling your monthly service, you may be eligible for a refund upon the return of your SIM Card or your SecuraPAL or both.  In order to find out, call us at 888-9SECURA or send us an email at [email protected] and clearly state that you want to return your SIM Card or your SecuraPAL or both and we will let you know if you are eligible for a refund.  Eligibility is based solely upon SecuraTrac’s ability to re-use the items.

Loss of Device Insurance and Deductibles

In the event that you lose your SecuraPAL, SecuraTrac device insurance will entitle you to a replacement unit at 50% off the then current retail price.  You must have device insurance in effect at the time of the loss in order to redeem the offer.   Insurance is billed using the same terms and conditions of the monthly service.   The Company reserves the right to review your account activity and insurance history prior to authorizing the replacement device and reduced pricing.

Rental Agreement Terms (applies to rentals only)

This service and the accompanying website(s) is operated by SecuraTrac LLC ("SecuraTrac," "we," "us," or "our"). Please read these Terms and Conditions ("Terms") carefully before entering into this rental agreement and prior to using the website and know that your use of this service represents your acceptance of these Terms. We reserve the right to change, add, or remove any of these Terms at any time by amending this agreement. Your use of this service following the posting of changes to these Terms means you accept such changes.

Those users who enter into the SecuraTrac rental service are required to provide accurate and complete information about themselves and to maintain the accuracy of that information. During registration customers create a username and password and both pieces of information are known as the customer credentials. Customers are responsible for maintaining the confidentiality of these credentials and are responsible for all activities that occur under those credentials whether expressly authorized or not.

Rental customers are able to convert their rental into a purchase either by explicitly stating their intent to buy or by keeping the rental and not returning it after the expiration of the grace period. The customer will be automatically charged the full retail price less any rental fees paid to that point. Customers will automatically get the unlimited nationwide monthly service plan. The rental units are not permitted to make use of the 30 day refund guarantee though all limited warranty rights persist and begin as of the date of their rental.

Limited Warranty

Subject to the terms and conditions of this limited warranty, SecuraTrac warrants to the purchaser that under the normal use of the product and service we will substantially perform to the level described in the accompanying printed materials for a period of one (1) year as of the date of your purchase.  This will be known as the warranty period.  During the warranty period SecuraTrac will, at its option, replace a defective SecuraTrac product. 

There is no warranty of any kind for any defects discovered after the warranty period.  The only remedy available for such defects is to purchase a replacement device and/or upgrade to another device.  Note: you may also have a condition under laws of certain jurisdictions, which are hereby limited to the duration of the warranty period. 

No other warranties or conditions are made with respect to the SecuraTrac product or service by any person or by SecuraTrac suppliers.  The warranty period is rendered null and void when the device is used for commercial purposes, has been opened or modified in any way, or has been used in a way contrary to the instructions provided.
